Terms of Use

1. The Service

Mouswerk provides AI-assisted job management software for trades and service businesses. Our AI assistant, Otto, helps draft quotes, schedules, invoices and health and safety documents and suggests actions. Otto proposes; you approve. Nothing is sent, booked, invoiced or actioned on your behalf without your approval.

2. Accounts and eligibility

• You must be at least 18 years old and authorised to act for your business.
• You must provide accurate information and keep your login details secure.
• You are responsible for all activity that happens under your account, including actions by your team members.

3. Your responsibility for AI output

Otto's drafts and suggestions are tools to assist you, not professional advice. AI can make mistakes. You are responsible for reviewing and approving anything before you rely on it, send it to a customer, or use it to meet an obligation. This includes quotes, invoices, tax treatment, and health and safety documents. Mouswerk is a tool to help you manage your operations and records; it is not a regulator and does not provide certification, legal, accounting or compliance sign-off. You remain responsible for meeting your own legal, tax and health and safety obligations.

4. Your data and content

You own the data and content you put into the Service. You grant us a licence to host, process and display that data as needed to provide the Service to you, including processing by our third-party providers. You are responsible for ensuring you have the right to provide any personal information you enter, and for using it lawfully. How we handle personal information is set out in our Privacy Policy.

5. Connected services

You may connect third-party services such as Xero and Google (Gmail). Your use of those services remains subject to their own terms, and you are responsible for the access you grant. You can disconnect them at any time from the Connections screen.

6. Acceptable use

You agree not to misuse the Service, including by attempting to access other organisations' data, disrupting or reverse-engineering the Service, uploading unlawful or infringing content, or using the Service to break the law.

7. Fees and billing

• Paid plans are billed in advance on a recurring basis at the prices shown on our pricing page. Prices are in New Zealand dollars and include GST.
• You authorise us to charge your chosen payment method for each billing period until you cancel.
• You can cancel at any time; cancellation takes effect at the end of your current billing period. Fees already paid are non-refundable except where required by law.
• We may change our prices or plans on reasonable notice, which will apply from your next billing period.

8. Availability

We work to keep the Service available and reliable, but we do not guarantee it will be uninterrupted or error-free. We may update, change or temporarily suspend features to maintain or improve the Service.

9. Disclaimers and liability

To the extent permitted by law, the Service is provided on an "as is" and "as available" basis without warranties of any kind. Where you use the Service for the purposes of a business, you agree that the guarantees in the Consumer Guarantees Act 1993 do not apply, to the extent the law allows this. Nothing in these Terms limits rights that cannot lawfully be excluded.

To the maximum extent permitted by law, Mouswerk will not be liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill. Our total liability arising out of or in connection with the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

10. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate access if you breach these Terms, if required by law, or to protect the Service or other users. On termination you may request a copy of your data within a reasonable period, after which we may delete it in line with our Privacy Policy.

11. Intellectual property

Mouswerk and its licensors own all rights in the Service, including the software, branding and Otto. These Terms do not transfer any of those rights to you. You keep all rights in your own data and content.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and change the date above. If you continue using the Service after changes take effect, you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction over any dispute.
